April Learning terms and conditions

  1. Applicability

These terms and conditions apply to all quotations, processes and agreements between April Learning and clients.

  1. Formation of the agreement

An agreement is formed as soon as a quotation or proposal is confirmed in writing or by email by the client. Verbal agreements only become binding after written confirmation. The agreement exclusively covers the services as described in the confirmed quotation.

  1. Execution of the assignment

April Learning carries out all assignments with care, professionalism and in close consultation with the client. We work based on the needs and context of the organisation, with an eye for the people involved. All programmes are carried out in accordance with the principles of the Ashridge Code of Conduct, which focuses on integrity, respect, confidentiality and the interests of the participant.

Individual coaching

In individual coaching, the development of the coachee is paramount. The conversations are confidential and information is only shared with the client if the coachee gives their explicit consent in advance. In consultation, feedback can be provided in broad terms about the process and progress.

Learning programmes for coaching in organisations

In learning programmes and training courses aimed at strengthening coaching, we work on goals that are tailored to the organisation. Attention is paid to visible application in practice. Confidential information may also be shared by participants within these programmes. This information is treated with the same care as in individual coaching: personal statements or experiences are never shared with others without permission. If desired, process-based feedback can be provided to the client in consultation.

If necessary, an external expert can be involved in parts of the programme, in consultation with the client.

  1. Cancellation and rescheduling

Individual coaching

A scheduled session can be cancelled or rescheduled free of charge up to 48 hours in advance.
In the event of cancellation within 48 hours, or in the event of non-appearance, the full fee will be charged.
In consultation, rescheduling may still be possible, provided there is space in the schedule and within a reasonable period of time..

Learning programmes, training courses and group meetings

No costs will be charged for cancellations up to 30 days before the start.
For cancellations between 30 and 14 days before the start, 50% of the agreed amount will be invoiced.
For cancellations within 14 days before the start, the full amount will be due.

If rescheduling is possible from an organisational point of view, April Learning will be happy to discuss this with you. Any additional costs (such as venue hire or preparatory work) will be charged separately.

Early termination

If a programme is terminated early by the client, the agreed amount will remain payable in principle. In consultation, we can consider whether a reasonable settlement is possible, depending on the situation and the parts already delivered.

Force majeure

In the event of force majeure (such as illness or unforeseen circumstances) on the part of April Learning, a new date will be scheduled in consultation. April Learning will take the client's schedule into account as much as possible.

5. Invoicing and payment

Invoices will be sent as agreed in the quotation or agreement.
The standard payment term is 14 days after the invoice date, unless otherwise agreed.
In the event of non-payment, statutory interest and any costs may be charged.
In the event of prolonged payment arrears, the service may be temporarily suspended.

6. Liability

April Learning is not liable for any direct or indirect damage resulting from decisions or actions taken by the client as a result of coaching or training. Any liability is always limited to the amount of the relevant assignment.

7. Intellectual property

All materials, models and working methods used or developed during a programme remain the property of April Learning. They may not be copied, distributed or reused without prior permission.

8. Confidentiality and data protection

Everything shared during programmes will be treated confidentially. Personal data will be processed carefully and in line with applicable privacy legislation (GDPR). See also the privacy statement on the April Learning website.

9. Complaints procedure and professional association

April Learning is a member of the NOBCO | EMCC (Dutch Association of Professional Coaches affiliated to EMCC Global) and works in accordance with the associated ethical guidelines. Complaints about professional conduct can be submitted to the NOBCO Complaints Committee. This independent committee handles complaints in accordance with established rules.

April Learning has professional and public liability insurance that complies with the standards of the professional association.

10. Applicable law

The cooperation with April Learning is governed by Dutch law. In the event of any disputes, an attempt will first be made to resolve them in consultation. If this fails, the court in the region where April Learning is located will have jurisdiction.
